This Privacy Policy explains how we collect, use, and protect your personal data.

1. Introduction

Patagram (“we”, “us”, “our”) is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our platform. We comply with the General Data Protection Regulation (GDPR) and other applicable privacy laws.

2. Data Controller

The data controller responsible for your personal data is Patagram, located in France. For privacy inquiries, contact us at: privacy@patagram.app

3. Data We Collect

We collect: (a) Account information: email, username, password (hashed), profile photo, bio; (b) Content you create: posts, comments, messages; (c) Usage data: pages visited, features used, timestamps; (d) Device information: IP address, browser type, operating system; (e) Payment information: processed securely through Mollie (we do not store card details). Data obtained from a third party (GDPR Article 14): for creators who connect a Mollie payment account, we also obtain your organization’s business identity from Mollie — business or legal name, address, chamber-of-commerce registration number, and VAT number where applicable. We obtain this from Mollie, not from you, on the basis of your consent (granted on Mollie’s authorization screen) and to perform our contract with you, namely to issue the legally-required invoices for your Patagram Pro subscription. It is stored with your Pro billing records and retained for the statutory invoice-retention period (see Data Retention below).

4. Legal Basis for Processing

We process your data based on: (a) Contract performance: to provide our services; (b) Legitimate interests: to improve our platform and prevent fraud; (c) Legal obligations: to comply with laws; (d) Consent: for marketing communications (which you can withdraw at any time).

5. How We Use Your Data

We use your data to: (a) Provide and maintain the Platform; (b) Process transactions and send related information; (c) Send notifications about your account or content; (d) Respond to your comments and questions; (e) Monitor and analyze usage patterns; (f) Detect and prevent fraud or abuse; (g) Send marketing communications (with your consent).

6. Data Sharing

We may share your data with: (a) Service providers (hosting, payment processing, email delivery); (b) Cloud infrastructure providers located within the EU for secure storage of uploaded content (images, videos, documents); (c) Legal authorities when required by law; (d) Other users (your public profile and content). We do not sell your personal data to third parties.

7. Data Retention

We retain your personal data for as long as your account is active. When you delete your account, deletion is not immediate: your account is deactivated at once and enters a 7-day grace period during which you can restore it by signing back in — this reversibility protects you against accidental or coerced deletion. After the grace period, we permanently erase your personal data (profile, content, media, and activity). Two categories are kept longer, by law and not by choice: (a) payment and invoice records — where Patagram is the merchant of record (for example your Patagram Pro subscription), the associated invoices and the business-identity details required to issue them are retained for the statutory invoice-retention period of 10 years, as we are legally obliged to under French Code de commerce Article L123-22; and (b) records we must keep for legal compliance, dispute resolution, or fraud prevention — including the record of any authorization you gave us to act on your connected payment account — retained for up to 3 years from the date the authorization ended. These retained records are archived separately from your live account and are not used for any other purpose.

8. Your Rights (GDPR)

Under GDPR, you have the right to: (a) Access your personal data; (b) Rectify inaccurate data; (c) Erase your data (“right to be forgotten”); (d) Restrict processing; (e) Data portability; (f) Object to processing; (g) Withdraw consent. You can exercise the access, portability, and erasure rights directly in the app: “Download my data” in your Settings gives you a machine-readable JSON copy of your personal data, and the Danger Zone in your Settings lets you delete your account (subject to the retention obligations in section 7). 9. Data Security

We implement appropriate technical and organizational measures to protect your data, including encryption, secure servers, and access controls. User-uploaded content is stored on EU-based object storage infrastructure with access controls and encryption at rest. However, no method of transmission over the Internet is 100% secure.

10. International Data Transfers

Your data, including user-uploaded content, is processed and stored on servers and cloud infrastructure located within the European Union (France). If we transfer data outside the EEA, we ensure appropriate safeguards are in place (such as Standard Contractual Clauses).

11. Children’s Privacy

Our Platform is not intended for users under 18. We do not knowingly collect personal data from children. If you believe we have collected data from a child, please contact us immediately.

12. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of significant changes by email or through the Platform. The updated policy will be effective upon posting.
