Terms of Service
Please read these terms carefully before using our platform.

1. Acceptance of terms
By accessing or using Patagram (“the Platform”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the Platform.
Definitions. In these Terms and the documents that refer to them, including the Creator Agreement and the Refund Policy: (a) a Follower is a user who follows a creator page or an account, free of charge; following involves no payment and gives access only to public content and to content the Creator reserves for followers; (b) a Subscription is the paid, renewable commitment by which a user supports a creator page at a given tier, billed on a recurring basis by the Creator; (c) a Subscriber is a user holding a current Subscription to a creator page. A Patagram Pro subscription, which a Creator takes out with Patagram, is not a Subscription in this sense (see the Creator Agreement, section 11).
2. Eligibility
You must be at least 18 years old to use this Platform. By using the Platform, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.
3. Account registration
To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
4. User content
You retain ownership of content you create and post on the Platform (“User Content”). By posting User Content, you grant Patagram a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your User Content in connection with operating the Platform. You are solely responsible for your User Content and represent that you have all necessary rights to post it.
5. Storage and bandwidth
Your account has a personal storage allowance of 5 GB and a monthly bandwidth (egress) allowance of 50 GB for the media you upload outside of a creator page (such as your avatar, banner, and posts you make as a regular user). Bandwidth measures how much your media is served to viewers each calendar month and resets at the start of each month. When you reach your monthly bandwidth allowance, your public media is temporarily paused (hidden from viewers) until the next monthly reset. Nothing is deleted. When you reach your storage allowance, new uploads are paused until you free space. These allowances are subject to fair use; we may pause uploads for an unusually large short-term spike to protect the Platform.
Large files must be limited-audience: any single file larger than 100 MB cannot be attached to a post that is public, followers-only, or shown as a public preview. Files over 100 MB may only be attached to posts restricted to paying subscribers (a paid tier). This applies to every account, including creators. Adaptive video streaming is not subject to this limit. Creators have separate, larger allowances per creator page. See the Creator Agreement for the full tier table.
6. Prohibited content
You agree not to post content that: (a) is illegal, harmful, threatening, abusive, harassing, defamatory, or invasive of privacy; (b) infringes any intellectual property rights; (c) contains viruses or malicious code; (d) constitutes spam or unauthorized advertising; (e) impersonates any person or entity; (f) contains sexually explicit material involving minors; (g) promotes violence or discrimination.
7. Creator terms
Creators who offer subscription tiers and/or sell digital products agree to: (a) provide the content, benefits, and products described in their offerings; (b) comply with all applicable laws regarding content creation, distribution, and digital commerce; (c) accept the applicable platform fee on subscription and product sales revenue, as displayed in the Creator dashboard; (d) adhere to the Creator Agreement for additional terms specific to monetization.
8. Subscriptions, purchases, and payments
Subscriptions are billed on a recurring basis. You authorize us to charge your payment method for all fees. Subscriptions auto-renew unless cancelled before the renewal date. If a Creator you subscribe to is banned or removed for violating our community guidelines, you will be notified, your subscription will end without renewing, and you keep access until the end of the period already paid for.
Digital products are one-time purchases, and are sold to you by the Creator rather than by Patagram. On payment you get immediate access to the files. That access does not expire, and it survives the Creator later taking the product off sale, closing their shop, or being removed from the Platform. Each purchase allows up to 25 downloads in total, counted across every file in that product, so that a single purchase cannot be used to redistribute a file at scale. We withdraw access to something you have bought only where the payment is reversed, such as a chargeback, or where we are required to take the file down, such as on a valid intellectual-property claim.
Refunds are handled according to our Refund Policy.
Physical goods are also sold to you by the Creator rather than by Patagram, and the Creator ships them. Your 14-day right to withdraw from the purchase cannot be waived and runs from the day you receive the goods; separately, goods that arrive faulty or unlike the listing are covered for 2 years. Both are exercised with the Creator, through the return request on your order. Patagram is not the seller, does not hold the money at any point, and cannot issue the refund. 9. Intellectual property
The Platform, including its design, features, and content (excluding User Content), is owned by Patagram and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express permission.
10. Termination
We may suspend or terminate your account at any time for violations of these Terms or for any other reason at our discretion. Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination will survive.
11. Disclaimers
THE PLATFORM IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE SERVICE.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Patagram SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.
13. Governing law
These Terms are governed by the laws of France. Any disputes shall be resolved in the courts of Paris, France, unless you are a consumer entitled to bring claims in your local jurisdiction under applicable consumer protection laws.
14. Changes to terms
We may modify these Terms at any time. We will notify you of material changes by email or through the Platform. Your continued use after changes constitutes acceptance of the modified Terms.
