By accessing or using Patagram ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Platform.
You must be at least 18 years old to use this Platform. By using the Platform, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.
To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
You retain ownership of content you create and post on the Platform ("User Content"). By posting User Content, you grant Patagram a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your User Content in connection with operating the Platform. You are solely responsible for your User Content and represent that you have all necessary rights to post it.
You agree not to post content that: (a) is illegal, harmful, threatening, abusive, harassing, defamatory, or invasive of privacy; (b) infringes any intellectual property rights; (c) contains viruses or malicious code; (d) constitutes spam or unauthorized advertising; (e) impersonates any person or entity; (f) contains sexually explicit material involving minors; (g) promotes violence or discrimination.
Creators who offer subscription tiers and/or sell digital products agree to: (a) provide the content, benefits, and products described in their offerings; (b) comply with all applicable laws regarding content creation, distribution, and digital commerce; (c) accept the applicable platform fee on subscription and product sales revenue, as displayed in the Creator dashboard; (d) adhere to the Creator Agreement for additional terms specific to monetization.
Subscriptions are billed on a recurring basis. You authorize us to charge your payment method for all fees. Subscriptions auto-renew unless cancelled before the renewal date. Digital product purchases are one-time transactions; upon payment you receive immediate access to the purchased product. Refunds are handled according to our Refund Policy.
The Platform, including its design, features, and content (excluding User Content), is owned by Patagram and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express permission.
We may suspend or terminate your account at any time for violations of these Terms or for any other reason at our discretion. Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination will survive.
THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Patagram SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.
These Terms are governed by the laws of France. Any disputes shall be resolved in the courts of Paris, France, unless you are a consumer entitled to bring claims in your local jurisdiction under applicable consumer protection laws.
We may modify these Terms at any time. We will notify you of material changes by email or through the Platform. Your continued use after changes constitutes acceptance of the modified Terms.
